Applicable to the WECAN Academy online learning platform

These Terms & Conditions govern the Workgroup of Cancer Patient Advocacy Network’s (WECAN’s) Online Learning Platform, the WECAN Academy,  (hereinafter referred to as the 'Online Learning Platform') which is owned and operated by the members of WECAN. You should not access or use this Online Learning Platform until you have carefully read and agreed to the following Terms & Conditions.

Definitions

The concepts in these terms and conditions have the following meaning:


  • Course: Content on the WECAN Academy including course modules, learning materials or training resources
  • WECAN:Workgroup of Cancer Patient Advocacy Network
  • Online Learning Platform: WECAN Academy
  • Terms: Collectively the general Terms & Conditions and Privacy Policy as they relate to the use of the WECAN Academy Privacy Policy: Privacy Policy of the WECAN Academy
  • User: each natural person who enrolls, creates an account, and accesses the Online Learning Platform


Use of the Online Learning Platform

WECAN offers Courses and training for patient advocates to grow their stills and expertise in the three pillars of successful patient advocacy: Advocacy Tools & Skills, Healthcare Systems, Policy & Access, and Research & Data as well as Evidence- Based Advocacy. In order to participate in Courses and access any online resources offered by the Online Learning Platform you must first carefully read and agree to these Terms.

By accessing and creating an account within the Online Learning Platform, you have indicated that you have read these Terms and agree to bound b and comply with them. If you do not agree to be bound by these Terms, please promptly exit the Online Learning Platform.

User Age and Eligibility

Participation in the Online Learning Platform and WECAN Courses are restricted to those individuals who have registered, who are 16 years of age and over and/or those who are fully able and competent to enter into these terms, conditions, obligations, affirmations, representations and warranties herein. By accessing the Online Learning Platform, you affirm that you meet the eligibility requirements.

If you have questions about your eligibility, please contact us at  Academy@wecanadvocate.eu. Certain Courses may also have additional eligibility requirements as specified in the specific course description. If you are not eligible for registration and participation or do not agree to the Terms, you may not use the Online Learning Platform.

Access to the Online Learning Platform

While portions of the Online Learning Platform may be available to the general public, portions of the Online Learning Platform are restricted to registered users who meet eligibility criteria. You agree that you will not access any registration-only portions of the Online Learning Platform if you do not meet the eligibility requirements. WECAN is not responsible for any delay, inability or failure to access the Online Learning Platform due to any cause, including but not limited to acts of God, natural disasters, government orders, labour unrest, malfunction of user hardware or software, interruption in internet service, loss or corruption of data, and unanticipated suspension or cessation of service from any underlying service provider.

User Accounts

In order to create a user account, you may be asked to provide:

  • your full name
  • an email address
  • your affiliated group or organization and disease area
  • your country
  • a public username
  • user password


To make account creation as seamless as possible, creating an account using an existing social media account has been enabled.

You agree that you will never divulge or share access or access information for your user account with any third party for any reason. In setting up your user account, you may be prompted to enter additional optional information. You represent that all information provided by you is accurate and current. You agree to maintain and update your information to keep it accurate and current. By creating a user account, you agree to receive information about WECAN’s Courses, resources, or other offerings.  We care about the confidentiality and security of your personal information. Please see the Privacy Policy for more information about the collection and use of data on the Online Learning Platform.

Services, Pricing and Availability

Whilst every effort is made to provide the Online Learning Platform to our community free of charge, WECAN reserves the right to charge access to some content on the Online Learning Platform. This may require you to include certain personal details and Payment Information which may vary based upon your use of the Online Learning Platform. By submitting Payment Information, you represent and warrant that you have permission to submit Payment Information where permission may be required All pricing information on the Online Learning Platform is correct at the time of going online. WECAN reserves the right to change prices and alter or remove any special offers from time to time and as necessary.  In the event that prices are changed during the period between an order being placed and updates to the Online Learning Platform and taking payment, then the price that was valid at the time of the order shall be used.

Course Modification or Cancellation

The Online Learning Platform, including the course materials, may contain errors and omissions. We reserve the right to correct errors or omissions without prior notice. We also reserve the right to cancel, discontinue, reschedule, delay, change instructors or modify any course or service.

Termination and Cancellation of Accounts

Either WECAN or you may terminate your Account. Shall your account be terminated, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, WECAN reserves the right to terminate without giving reasons. If your Account is terminated, any current or pending orders or payments on your Account will be cancelled and provision of Services will not commence.

Intellectual Property Rights - Right of Use

All intellectual property rights that belong to the Online Learning Platform are held by and remain with WECAN. The Online Learning Platform is property of WECAN.

Trademarks, logos, images, pictures, animations, videos and texts on the Online Learning Platform are the intellectual property of WECAN and cannot be reproduced, used, published, distributed, sold or shown without the explicit, previous and written authorization. Unless otherwise indicated, course content and resources on the Online Learning Platform are provided under the Creative Commons License (CC BY 4.0). This license means you are free to:


  • Share — copy and redistribute the material in any medium or format
  • Adapt — remix, transform, and build upon the material for any purpose, even commercially without express written permission, but under the following terms:


You must give appropriate credit. This includes the name of WECAN and course instructors as creators, a link to the CC BY 4.0 license, a copyright notice, a license note, a disclaimer notice, and a link to the original material.

You must indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use.

You may not apply legal terms or technological measures (e.g. access restrictions) that legally restrict others from doing anything the license permits.

We ask that you give credits to WECAN and course instructors when using materials from this Online Learning Platform.

Some content on the Online Learning Platform is provided by third parties, and the use of that content is subject to rules and restrictions as indicated on the Online Learning Platform. You agree to be bound by all such rules and restrictions.

Modifications to Online Learning Platform

WECAN reserves the right, for any reason or no reason, in their sole discretion and without notice, to terminate, change, suspend or discontinue any aspect of the Online Learning Platform, including without limitation, information, data, text, music, sound, photographs, graphics, video, messages, Courses, Materials, features and/or hours of availability, and we will not be liable to you or to any third party for doing so. We may also impose rules and limits on the use of the Online Learning Platform or restrict your access to part, or the entire, Online Learning Platform without notice or penalty.


Rules for Online Conduct

You are responsible for your own communications, including the upload, transmission and posting of information, and are responsible for the consequences of their posting on or through the Online Learning Platform. You further agree that you will not email or post malicious or harmful content anywhere on the Online Learning Platform, including without limitation the following:


  • Content that defames or threatens others; Harassing statements or content that violates federal or state law;
  • Content that discusses illegal activities with the intent to commit them;
  • Content that is not your own, or infringes another's intellectual property, including, but not limited to, copyrights, trademarks or trade secrets;
  • Content related to partisan political activities;
  • Material that contains obscene (i.e. pornographic) language or images;
  • Advertising or any form of commercial solicitation or promotion, including links to other Online Learning Platform
  • Content that is otherwise unlawful;
  • Intentionally incomplete, misleading or inaccurate content;


Copyrighted material, including without limitation software, graphics, text, photographs, sound, video and musical recordings, may not be placed on the Online Learning Platform without the express permission of the owner of the copyright in the material, or other legal entitlement to use the material.

Security Rules

Violations of system or network security may result in civil or criminal liability. You agree that you will not violate or attempt to violate the security of the Online Learning Platform, including without limitation: attacking, probing, scanning or testing the vulnerability of, breaching security of, disrupting, disabling or harming the Online Learning Platform, or servers or networks connected to the Online Learning Platform using the Online Learning Platform via any automated means, such as a screen-scraper or robot. This is not intended to exclude the use of assistive technology for your own use, such as screen-readers.

Content Disclaimer

The text and other material on the Online Learning Platform may include the opinion of the specific instructor and are not statements of advice, endorsement, opinion, or information of WECAN. If you feel you might be offended by the content of the Online Learning Platform, you should not continue. Online Learning Platform may also include the personal opinions and other expressions by Users who post entries on a wide range of topics. Neither the content of the forums, nor the links to other web Online Learning Platforms, are screened, approved, reviewed or endorsed by WECAN or any other related entity. Although WECAN has the right to remove content from the Online Learning Platform, block access, or take other action with respect to the material in their sole discretion.


WECAN
accepts no liability (including liability for negligence) for any loss or damage (including the consequential or indirect loss or damage) that may arise in any way from access to, use of, or inability to use this resource or any material contained in it.

As a User, you are advised to verify all relevant representations, statements, and information. The entire risk arising out of the use of the materials presented in the Courses are distributed as an information source only. Any information provided is for the purpose of general guidance. WECAN makes no guarantees that you will obtain a particular outcome. Finally, these Courses are NOT designed for people who want to create and sell Courses.

User Content

You may be permitted to submit and distribute materials in connection with an online course ('User Content'). You represent and warrant that any material you submit to the Online Learning Platform, instructors or other Users is accurate and complete and will not violate or infringe the rights of any third party, including without limitation privacy, publicity, intellectual property and any other proprietary rights, such as copyright, trademark and patent rights. You represent and warrant that you have all the necessary rights and licenses to use the material and to permit use of the material by WECAN and other researchers. You agree that, if a third-party claim that any material you have contributed to the Online Learning Platform is unlawful, you will bear the burden of establishing that the material complies with all applicable laws. Although WECAN does not monitor the content of the Online Learning Platform, they have the right to remove material from the Online Learning Platform, block access, or take other action with respect to the material in their sole discretion.  


Grant of License

By your submission of any material in connection with this course, you hereby grant WECAN an irrevocable, non-exclusive, royalty free, fully transferable, worldwide license to use, disclose, reproduce, distribute, prepare derivative works of, publicly perform, publicly display and provide to other researchers any such submission. You hereby grant Users a license to use your User Content (including the right to copy, modify and distribute such content) in conjunction with their participation in the course.

User Status and Certificate of Accomplishment 

You agree and acknowledge that your access to the Online Learning Platform, participation in an online course and your agreement to these Terms do not confer any right to access or use the resources of WECAN or establish any relationship with them or their instructors beyond the Online Learning Platform, and that you are not entitled to any student or academic grievance procedures. You agree that no joint venture, partnership, employment, or agency relationship exists between

WECAN and you as a result of these Terms or your use of the Online Learning Platform. Subject to satisfactory performance and course completion, you may receive a Certificate of Accomplishment or Completion ('Certificate'). WECAN reserves the right to determine whether a Certificate will be issued for the online course and the nature of the information to be provided in the Certificate. You acknowledge that any Certificate will not confer any academic credit, grade or degree. You further acknowledge that instructors of any online course are not required to participate in any attempts to get the course recognized by any educational or accredited institution.

Use of your Personal Information

By providing any personal information to the Online Learning Platform all users, fully understand and unambiguously consent to the collection, transmission processing and storage of such information by WECAN. Your personal information may be used to:
  • Provide Services to you;
  • Process your payment; and
  • Inform you of new products and services available from Us.


You may request that we stop sending you this information at any time.

In certain circumstances (if, for example, you wish to purchase content on credit), and with your consent, your personal information may be passed on to credit reference agencies. These agencies are also bound by the Data Protection Act 1998 and should use and hold your personal information accordingly.

Third Party Links

The Online Learning Platform may include hyperlinks to Online Learning Platforms or websites maintained or controlled by others. WECAN is not responsible for and does not routinely screen, approve, review or endorse the contents of or use of any of the products or services that may be offered at other Online Learning Platforms. These links do not imply WECAN's endorsement of or association with the linked Online Learning Platforms. WECAN is not responsible for and shall in no event be liable, directly or indirectly, to anyone for any loss or damage arising from or occasioned by the creation or use of the linked Online Learning Platforms or the information or material accessed through those linked Online Learning Platforms.


 Choice of Law/Forum Selection 

The Online Learning Platform is managed by members of WECAN.  WECAN is not a legal entity but an informal network, the Online Learning Platform is hosted by the European Patient Advocacy Institute Germany. You agree that any dispute arising out of or relating to these Terms or any content posted to the Online Learning Platform, including copies and republication thereof, whether based in contract, tort, statutory or other law, will be governed by the laws of Germany, excluding its conflicts of law provisions.


Limitation of Liability

The information on the Online Learning Platform is of general nature and how it relates to patient advocacy within Europe. The information is not customized to personal or specific circumstances. The Courses are provided for educational purposes only.

WECAN will do its best to ensure that the information provided is complete, correct, accurate and updated. EUPATI does everything necessary to protect as good as reasonably possible the User’s data they have introduced in the Platform against loss, theft or unauthorized access. 

Despite these efforts, irregularities may occur in the information provided. WECAN cannot be held liable for direct or indirect damage resulting from the use of the information on the Online Learning Platform or for direct or indirect damage resulting from inaccuracies in the information provided.

The contents of the Online Learning Platform(including possible links) can always, without notification or communication, be adapted, modified or complemented. WECAN does not give guarantees for the good functioning of the Online Learning Platformand can in no way be held liable for its wrong functioning or temporary (un)availability or for any form of direct or indirect damage that would result from the access or the use of the Online Learning Platform.

 

Under no circumstances, directly or indirectly, in a particular or any other way, can WECAN be held liable for damage due to the use of this Online Learning Platform or any other, particularly as a consequence of links or hyperlinks, including, without limitation, losses, work interruptions, damage to programs or other data on the computer system, damage of devices, software or other.

The User acknowledges and accepts that the Online Learning Platform can never be perfect or 100% free from imperfections and that not all imperfections will be (can be) repaired.

Copyright Complaints

WECAN respects the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please contact us at Academy@wecanadvocate.eu and provide the following written information: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (ii) a description of the copyrighted work that you claim has been infringed upon; (iii) a description of where the material that you claim is infringing is located on the Online Learning Platform; (iv) your address, telephone number, and email address; (v) a statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent or the law; and (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Notices

Notices to you will be made via email. Notices concerning the Online Learning Platform should be directed to the email address  Academy@wecanadvocate.eu. The Online Learning Platform may also provide notices of changes to these Terms or other matters by displaying notices or links to notices to you on the Online Learning Platform.

General Information

WECAN’s failure to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect. You may not assign the Terms or any of your rights or obligations under the Terms without WECAN's express prior written consent. The section titles in the Terms are for convenience only and have no legal or contractual effect.
